Also known as maternity salary or maternity leave, the benefit is a right of women who have withdrawn from their professional activity for reasons related to maternity.
They are, birth of a child, non-criminal abortion, adoption or legal custody for adoption purposes.
The request for this benefit is made completely online and you do not need to go to an INSS office.
So, pay attention to the information below to understand the procedure and request your benefit
Who is entitled to receive?
In order to qualify for the benefit, you must meet any of the following requirements on the date of childbirth, abortion or adoption:
- Being MEI (Individual Microentrepreneur);
- Being unemployed, but still receiving unemployment insurance;
- Be a maid;
- Being in a situation of death of the mother that generates the right to additional payment for the widowed spouse.
How long can I receive maternity pay?
The payment period will vary according to the reason that gave rise to the right:
- For cases of childbirth, the period is 120 days;
- In cases of adoption or legal custody for adoption purposes, the period is 120 days, for adoptees aged 12 years or less;
- In cases of stillbirth, 120 days;
- In case of miscarriage, 14 days.
How to apply for maternity aid?
- First, you will download the app. My INSS on your smartphone;
- After that, open the app;
- Click on the “New Order” button;
- Enter the name of the service/benefit you want;
- In the list, click on the name of the service/benefit;
- Read the text that appears on the screen and proceed by following the instructions.
Check the required documentation
- Mandatory:
- CPF data;
- In case of leave 28 days before the date of delivery, it is necessary to have a specific medical certificate for pregnant women.
- For the case of custody: it is necessary to be in possession of the Term of Custody with the indication that the custody is intended for adoption.
- In case of adoption: it is necessary to present the new birth certificate issued after the court decision.
- In cases of attorney or legal representative:
- It is necessary to carry the power of attorney or term of legal representation (guardianship, curatorship, term of custody);
- In addition to the identification document with photo (RG, CNH or CTPS) and CPF of the attorney or representative.

- Enter My INSS;
- Click on the “Check Orders” button;
- Find your process in the list;
- To see more details, click on “Detail”.
